Following a ruling by the Court of Cassation on January 14, 2025, the Directorate General for Labour (DGT) has published a Q&A document aimed at clarifying the interpretation of regulations and harmonizing practices regarding Specific Health and Safety Plans (PPSPS) on construction sites subject to SPS coordination. The Court's decision, issued after a fatal accident during maintenance work on a tower crane, reiterates that the obligation to establish a PPSPS applies to all companies whose work "contributes to the completion of the construction project." From now on, the determining criterion is no longer the contractual relationship, but the nature of the actions actually carried out on the site. This clarification should broaden the number of companies concerned and strengthen the organization among stakeholders. In practice, more actors will need to participate in risk analysis, the description of operating procedures, and the harmonization of prevention measures within the General Coordination Plan (PGC SPS).
